APPLYING FOR A KENYA DEPENDENT PASS (KDP): MUST KNOW!

If you are in the process of applying or planning to apply for a dependent pass for your spouse, children or any other person in Kenya, here are a few simple facts that you must know:

You can apply for a dependent pass for the following:

1. Legally Married spouse of opposite sex ( Marriage certificate a must).

2. Your children below the age of 18 years ( Birth certificates showing your relationship to them required)

3. Any other person that absolutely depends on you eg parents, brother or sister among others( You Must qualify this using documentary evidence such as medical documents etc)

NB: The following people SHALL NOT be given a dependent pass in Kenya:

1. Gay couples.

2. Un-married partners.

3. Fiances/boyfriends or girlfriends.

4. people who are a security threat to Kenya to mention just but a few.

Although spouses of Kenyans are entitled to a dependent pass on application in the prescribed manner, the Department of Immigration vets all such applications and considers them on case by case and may at any time request for additional documents to support the application….such application can also be rejected!

    Your post says that unmarried partners will not be issued a dependents pass. What if the unmarried partner absolutely depends on me (as in #3 in your first list)? For instance, I claim my unmarried partner as a dependent on my US income tax forms; she has no income of her own and she is completely reliant on me. Is it possible that she can qualify for a dependent’s pass under those circumstances? Would also love to know what kind of documentation the Immigration Department might request to prove dependency.     my question is for the last 6 months I have been here in kenya.with a woman I have known for nearly two yearsI came here on a regular 3 months visa and received a 3 month extension.I have button up lodge and build a nice home and I am pretty well self-contained with food as far as maze vegetables and chickens.as far as culture goes she is my wife and we are marriedbut not in a church I am looking to get my resident visa so I can stay and continue building my life with this woman. is this possible for me to get my dependent visa she depends on me completely she has no workshe is from Kenya I am from the US

    I am British Citizen who is married to a Kenyan lady. We married in Nairobi, and the the marriage was certified both at Nairobi Register Office and in the Kadhi Courts under the Mohammedan Act. I have been living in the UK for 3 years with my wife and now are considering a move to Nairobi. We both have family ties and economic connections in Kenya.
    Please advise if I would qualify for a Dependants Pass in Kenya by virtue of my wife holding a Kenyan citizenship. Also my daughter born in the UK. Would she too qualify, and if so, please could you advise as to how long on average the procedure takes place

      As you well know Kenya and many African countries are very traditional and patriarchal. Although you qualify for dependent pass my experience is that Kenya Immigration is very hesitant to issue depend pass for male spouses. You said you also have family connections in Kenya? Please explain this further. You have other options and I am happy to offer you advisory on a full range of options at your disposal at an agreeable fee.     I take particular objection to the fact that whilst Kenya is a patriarchal society, it is ultimately the Kenyan Constitution which along with the legislature that continues to govern Kenya and its people. It would therefore be unconstitutional and hence ILLEGAL for any office or officer thereof to act in a manner which would promote his/her societal or cultural values and viewpoints which would be placed in juxtaposition to the Kenyan Constitution. Surely the Legal framework must come before anything else.

    • I appreciate your objections to that state of affairs…. Unfortunately that is how things are. I have enough experience with such incidents where a male spouse is either denied the dependent pass or it takes forever to be issued if it ever does. You may try your luck with the process. Please also note that even if Immigration gives you the dependent pass you CANNOT work! You will only be allowed to be a stay home dad! If you have to work or engage in business you will still need to apply for work/Investor permit. Like I said you have other options to reside in Kenya.

    i am a kenyan lady (citizen) married to a french man, we were married at Sheria house so our certificate is certified, both by the kenyan and the french laws.
    we have been living in france and visiting kenya once in a while, on a visitors visa for my husband.
    my question is, if we decide to move to kenya in the years to come, does my husband qualify for a dependant pass, how long does the process last and how long is the validity of the dependant pass ( yearly?)

    I have all the requirements in place, married to my Kenyan husband (I am Danish myself). Now my question is, how fast can they do the procedure? My Visa is expiring, and we would be very unhappy to know that I have to travel all the way back to Denmark, just to come back again.

      I would like to know when you got the visa anf how long have you been in the country. Further, if you are in Nairobi and have some time, you can pass by my office in Westlands for a discussion on this issue. On timeliness, like all governmnet processes in Kenya, it is not clear but I don’t believe that you have to got to Denmark because of the visa.

      • Hi Patricia.
        A dependent pass as the name suggest is dependent on the principal or the person being depended on. Therefore its validity would be pegged on the status of the principal. For dependents of Kenyans, especially the spouse, it is life long…for children up to the age of majority. However, please note that the re-entry pass for such dependents has to be renewed every two years! FYI the re-entry pass is what allows you to travel out of the country and re-enter without having to pay for a visa if you come from visa national countries and is normally endorsed at the back of your passport using a wet ink stamp.

      • My Visa will expire this Saturday the 27th, so we are in a lot of time pressure, since we cannot apply before Friday the 26th. Therefor we are hoping and praying they can handle the case the same day we come. But let’s say we apply on Friday, and they tell us everything is fine, but they cannot give us the pass the same day. Let’s say, they tell us to come back next week. That means, my Visa will then have expired. Would that mean I have to travel, or is it enough that we already applied?

      • Hi Therese. Sorry for that state of affairs. I am not sure that all is lost yet. Please note that you can not apply and get a Dependent pass same day…it will probably take even more than a Month as background checks are being done. However, it is possible after application for you to request them to give you a status in Kenya as you wait for its issuance. Normally that would be what is referred to as Kenya Visitor’s pass- Investigating Settlement (KVP/3M/IS)( can be up to 3 months depending on the officer issuing it.This is not guaranteed but the officers will consider it and advise you accordingly.
        Please note that the only information I am using to advise you is what you have provided…..if you need professional advise you can get in touch with your professional Immigration advisor or go in person to Kenya Immigration for guidance. I am available to advise if instructed so by you but you don’t have to if you feel you can manage it on your own or can go to Immigration and sort it out. That is the much advisory am able to offer you on this forum and free of charge.

      • Therese, George will know better than I, but if you are on a tourist visa you can leave the East African Community and return to get a new tourist visa (or, if you have never renewed your tourist visa, go to Nyayo House and renew there for another 3 months). There is certainly no need to go back to Denmark under these circumstances. Of course if you have a different visa it might be different.

      • Hi George, if I get approved to be a dependent of my Kenyan husband, does that mean I can permanently stay in Kenya without having to renew visas or am still required to renew and/or leave the country every 3/6 months? We are looking to only stay in Kenya for about a year and half to allow the birth of our first child and to process visa requirements to my home country.

      • Hi Samantha. Once you get a dependent pass then you are good to stay up to the end of the validity of the principal sponsor of the Dependent pass if such a person is not Kenyan. If you are a spouse of a Kenyan the Dependent pass does not expire but you must renew your re-entry pass every two years to allow you to re-enter Kenya every time you travel without having to buy a visa.

    • You can apply for a dependant pass even if you don’t reside in Kenya as long as you have the correct documents. If you application early and make sure the KDP and reentry is endorsed in your passport then you can avoid the visa….but you will have to make at least one trip on a visa because the endorsement is only done in Kenya!

    I´m currently having a work permit and have applied for an extention. But the work permit is expiring beginning of October.
    So we were wondering if we can also apply for a dependants pass for myself.
    How long does the process usually take and for how long will the pass allow me to be in the country?

    • Hi Simone
      Yes you can apply for the dependent pass. It can take awhile….even three months depending on the workload and who is doing the follow up for you. Once issued, you can stay in Kenya forever as a spouse of Kenyan….but you must get a reentry pass endorsed in your passport every two years. This allows you to reenter Kenya in case you travel outside the country without having to pay for a visa.

    We have been married for nearly twenty years and are now retired I have looked at the Dependents Pass and the Spouse’s Citizen Registration but am not sure which one to apply for.

    The forms and supporting documentation seem straightforward but looking at the various blogs etc. it seems that additional documents to those listed may be required so I would like to be prepared for this.

    • I actually don’t get your question…the kenyan…..a she who is married? Then how would your American friend marry a married woman? While polygamy is allowed in Kenya on common law type of marriages, I have not heard a woman marry two men!

      • Well…That is a very tricky affair coz they must produce a marriage certificate….common law marriages to non Kenyans wont confer dependent pass….even in Kenya polygamous marriages do not have marriage certificate….in this case only the first wife, if not Kenyan, can get a dependent pass.

    Before 6 months I call my family here on visit visa, and extended their visa for 1 time.

    • About the endorsement….yes you should have it done on your passport. It is for your benefit to avoid carrying it all the time. Secondly without the endorsement every time you travel you will need a visa to reenter Kenya. You child can get a dependent pass on your hubby if the birth certificate has his name and details.

        Is Kenyan Immigration hesitant in granting KDP to any nationality male spouses or others are granted? Also do I have to adopt his kids through law in Kenya or India?

    I am an Austrian woman married to a Kenyan man- i got the dependence pass. Now we moved back to Austria but want to of corse go back and visit Kenya once in a while. Can i anyhow get the re-entry permisson also outside of Kenya- probably at the embassy here in Austria to avoid visa fees at re-entry? Where do you normally get this re-entry permission from?
    My second question is if with the kenyan dependence pass i can also avoid other visa fees for example in Tanzania, the rest of east africa or also other countries who are visa-free for Kenyans?

      • Well, that is not true. I know with a dependent pass and Alien card you can travel to Uganda and Rwanda on an interstate pass but not Tanzania. However you are at liberty to seek further clarification from Kenyan Immigration. If you are in Australia please speak to Immigration attache Lawrence Kanampiu. You can tell him I advised you.

        Sorry about the mix up on Australia and Austria. Actually I find not confusing information probably because I have worked for Immigration for long. The position is that if you reside in East Africa your residence in one does not allow you free travel across the states. However they are working on this to ease travel in EAC. Interstate pass is a paper that allows citizens/residents of Kenya, Uganda and Rwanda to travel to either country using National ID or Alien cards

    • You can still apply for her Dependent pass and provide medical documents to support that application and definitely that should be considered. Make it clear it is because of her condition you want to apply for the KDP. Out of curiosity, how is that your father is Kenyan yet your sister holds a Dependent pass?

So they registered the birth as outside the mother country. She still has her Kenyan birth certificate. Can she not use the same dependant pass she is holding or she needs to apply for a new one?

  28. Dear George! We also talked quite a while ago. I am an Austrian woman married to a Kenyan- both living in Austria. We are still in the process of trying to get a dependence pass. The major problem is the re-issuing which they told me has to be done every time again once i step longer out of the country. Since we wanted to have it to not all the time pay visa in Kenya (my husband also doesnt pay to enter my country), its almost an impossible thing- because you enter free only with a valid dependence pass- which will never be valid if it has to be re issued in Kenya. Do you have any solution for that problem? Why is it not possible to do that at the Kenyan embassy in Austria? Btw: do i pay visa in Tanzania, Uganda, Rwanda with a Kenyan dependence pass?       Yes your husband can apply for a dependent pass but Immigration has been hesitant to issue dependent passes to male spouses.
      The government fee is Kshs. 5000.

      Although you have a right to apply for a dependent pass, I see little possibility of getting it then because Immigration has been very reluctant to issue dependent passes to male spouses of Kenyans.

    • You are raising two issues here: lost documents and KDP. As for the lost documents your hubby must get new ones from his country. For KDP you can apply but most likely will not be issued because Immigration is not keen on issuing KDP to male spouses of Kenyans.

Is it possible to add my spouse’s names to my passport and that of my daughter? we have also be living with my late sisters daughter for the last 13 years.     • Hi Kanini.
      You can add your husband’s name to your passport by availing copy of your marriage certificate. Your daughter can not until your husband adopts her lawfully. Your sister’s daughter too can’t acquire your name unless after she is adopted by you which I think at that age is not possible.

Hi my daughter has been on a depandants pass for the past 11 years.She is a full time vet student and also doing her Masters degree so is totally depandant on us.We are on a K pass.Up until recently she has had the renewal stamped in her passport until some one said this was no longer possible as she is over 23 years old.When she arrived home this June for the holidays the immigrstion officer at the airport said she is entitled to have the re entry stamp as she has evidence of being a full time student who the university has stated is not allowed to work because of the demands of the veterinary medicine degree.Do you have any advise?
